Sometimes in Florida we hear from insurance companies about something that’s called The Family Immunity Doctrine. Here’s the thing, and it’s a crazy thing, so listen to me now. Florida has abolished The Family Immunity Doctrine. One family member, under the law, can sue another family member in Florida. But, and this is the crazy part, insurance companies in Florida are allowed to exclude crimes or torts or anything else committed by one family member against another. By law, can you bring that lawsuit? Sure. Do you have a case? Yes, absolutely, but be careful. Look at that insurance policy and find out whether it’s excluded. It might be.
