Even if you were mostly at fault, you’re still going to have a claim against the other person’s insurance company. What do they have to pay for? They have to pay for the harm that they caused, so if they caused 20% of the harm then they need to pay 20% of the damages. It’s the only fair way to do it and that’s the law we have in Florida.
