Can a Minor file a Florida wrongful death claim?

Minors can bring Florida wrongful death claims or any other kind of lawsuit. There’s a process that adults have to go through for the minors. Can the minor do it himself or herself? No, not exactly, because they’re not adults so they don’t have what we call legal capacity. It absolutely can be done in their name, either by parents or by their natural guardians, or sometimes the court has to step in and appoint somebody to do it for them. If a minor has a right to a legal cause of action, then there’s a legal way for them to bring it, absolutely.
