Does an insurance company have to pay for a rental car when repairs are being made to my vehicle?

When your vehicle’s damaged, and it’s in the shop, the insurance company for the person who caused the damage should absolutely put you in a rental car, and they should put you in a rental car that’s at least as good as the vehicle that is yours and that you’re not able to use because of the wreck. If they don’t want to do that, then the right way to handle it is to just say, “Look, the person who wrecked me car, they’re responsible. I’m going to sue them if that’s what you want.” Then they can work it out with you as far as what you were supposed to do or what you weren’t supposed to do. Most of the time insurance companies are going to just pay for the rental car. They just want to see if they can get away with paying less.
