After I filed my claim, my insurance company offered me a settlement for less than my damages. Must I take it?

You never have to take a settlement that is for an amount of money that you think is less than the amount of money that you’re entitled to because of the harm that was done to your property or to you personally. If you’re getting an offer to settle that’s not as much money as it takes to make you whole, to put you back where you would have been if the accident had never happened, certainly, you don’t have to take it.

You have every right to say “no.” You have every right to explain to the insurance company why you think the number should be higher. Hopefully, the two of you are able to come to an agreement and work it out.
